Health workers in Kansas have launched a class action lawsuit against a directive forcing them to report to the state authorities all sexual activity by under-16s.
Kansas is one of 12 states where sex under a certain age - whether 16, 17 or 18 - is illegal regardless of the age difference between the participants, but the state's attorney general, Phill Kline...(i)n a policy directive three years ago...argued that any pregnant, unmarried minor had by definition been a victim of rape or abuse, and that reporting had to be mandatory whenever there was "compelling evidence of sexual interaction".
...an assistant district attorney defending the suit, said that under-16s are incapable of consenting to sexual activity. Whoever violates the law, he said, must forfeit their rights to privacy.
Studies suggest that across the country, some 30% of teenagers under 16 have had intercourse, and an additional 20% have had oral sex or genital fondling.
